5. EU Default MRL (0.01 mg/kg) — The "Derogation Gap"

Since January 2020, chlorpyrifos and chlorpyrifos-methyl have been banned in the EU (no MRL set — default 0.01 mg/kg applies). Many non-EU suppliers previously relied on these actives. Any paprika found with > 0.01 mg/kg of these substances is rejected at EU border. Suppliers must demonstrate that:

  1. Chlorpyrifos/chlorpyrifos-methyl have been replaced with approved alternatives (e.g., pyrethroids, spinosad, neem-based products).
  2. Field transition period (soil half-life of chlorpyrifos: 10–120 days) has elapsed.
  3. Testing confirms ND (< 0.01 mg/kg) for every lot destined for EU.
